This Terms of Service agreement (“Agreement”) governs the use of services provided by scanO Health Technologies Private Limited (“scanO,” “we,” “us,” or “our”), a private limited company incorporated under the Companies Act, 2013, having its registered office at Office 215, Crossroads, Bhumkar Chowk, Wakad, Pune 411057, Maharashtra, India.
By accessing or using any of our websites, applications, devices, software products, or subscription services (collectively, the “Services”), you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree with these terms, you may not access or use our Services.
- Eligibility
You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Services. If you are using the Services on behalf of an entity, you represent and warrant that you are authorized to bind such entity to this Agreement. - Description of Services
scanO offers AI-powered dental health tools and platforms, including:- scanO air: A hardware-based intraoral imaging and analysis device
- scanO engage: A subscription-based software platform for dental professionals, used by clinics across India, UAE, Jordan, Africa, Philippines, and Singapore
These Services may be offered as stand-alone products or integrated systems, and may include data analytics, image processing, patient engagement tools, and clinical documentation features.
- Subscription Terms
scanO engage is provided on a subscription basis and may be subject to monthly or annual billing. Subscriptions will renew automatically unless cancelled by the user prior to the renewal date.
3.1. Pricing and Billing
Payment is collected through authorized third-party processors, including but not limited to Stripe. You agree to provide current, complete, and accurate payment information.
3.2. Auto-Renewal and Notifications
Unless otherwise specified, your subscription will automatically renew at the end of each billing cycle. You will be notified of upcoming renewals through the email associated with your account. - Refund & Cancellation Policy
4.1. For Software Subscriptions (scanO engage):
Cancellations may be made at any time via your account dashboard or by contacting support at [email protected].
Full refunds will be issued for cancellations requested within 7 calendar days of the initial purchase or renewal.
No refunds will be processed after 7 days; however, you will retain access to the Services for the remainder of the billing cycle.
4.2. For Hardware Products (scanO air):
Devices are non-refundable unless defective upon delivery.
Claims for defective devices must be submitted within 7 calendar days of delivery, along with proof of purchase and defect.
Replacement or repair shall be provided in accordance with product-specific warranty terms. - Acceptable Use Policy
You agree not to:
Use the Services for any illegal, abusive, or unauthorized purposes
Reverse engineer, disassemble, or attempt to extract source code from our Services
Distribute or misuse scanO’s proprietary AI outputs for non-clinical or misleading applications
Use the Services in a manner that infringes upon any third-party rights - AI & Medical Disclaimer
scanO provides AI-generated analysis intended to assist dental professionals. These tools are not a substitute for a clinical examination or licensed medical advice. The final responsibility for diagnosis, treatment planning, and patient care rests solely with the healthcare provider.
scanO disclaims any liability for medical decisions made solely based on AI-generated reports. - Data Use, Privacy & Deletion
scanO collects, stores, and processes data including intraoral images and patient-related metadata strictly for the delivery and enhancement of Services. All data handling practices comply with the Information Technology Act, 2000 (India), GDPR (where applicable), and other relevant data protection laws.
7.1. Data Deletion Requests
Users may request permanent deletion of their data by emailing [[email protected]] with the subject line: “Data Deletion Request.” Upon verification, data will be deleted within 15 business days, unless retention is required by law. - Intellectual Property
All content, software, trademarks, AI models, logos, and technology associated with the Services are the exclusive intellectual property of Trismus Healthcare Technologies Private Limited. No rights or licenses are granted except as expressly stated in this Agreement. - Termination
We reserve the right to terminate or suspend access to the Services at our sole discretion, with or without notice, for conduct that we believe violates this Agreement or is harmful to other users, scanO, or third parties.
You may terminate your use of the Services at any time. Termination does not relieve you of payment obligations incurred prior to termination. - Limitation of Liability
To the fullest extent permitted by law, scanO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or related to your use of the Services. - Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra. - Modifications to Terms
scanO reserves the right to revise or modify these Terms at any time. Updates will be posted on our website and communicated via email. Continued use of the Services constitutes acceptance of the revised Terms. - Contact and Grievance Redressal
